AVOIDING FORECLOSURE AND

On October 17, 2005, the new Bankruptcy Code came into effect.
One of its provisions is that all debtors receive, within 180 days prior to filing for bankruptcy protection, and from an approved nonprofit budget and credit counseling agency, "an individual or group briefing that outlines the opportunities for available credit counseling."
In addition, in order to obtain a final discharge, each debtor must participate in a
personal financial management course after filing his/her petition.
(Even if the Code did not require this
counseling, we have always recommended it.
You should obtain a 3rd party's evaluation of your situation before deciding on
filing for bankruptcy protection.)
